Fast-Tracking Your Green Card Through EB-5 Rural Investment

Rural TEA investment initiatives present a viable pathway for foreign investors to secure permanent residency in a timely manner, given the current abundance of rural visas. This moment is particularly opportune to capitalize on this prospect before the anticipated rise in demand for rural projects within the EB-5 program potentially results in oversubscription.

Rural TEA projects are classified under Targeted Employment Areas (TEAs), which are designated by the government to promote foreign investment aimed at stimulating economic development. While lengthy wait times and backlogs have historically been an issue, the EB-5 Reform and Integrity Act of 2022 (RIA) has implemented a system of “priority processing” for rural EB-5 applications. This measure guarantees that rural petitions receive precedence, thereby accelerating the processing time relative to other EB-5 applications.

With the establishment of the rural visa quota and the introduction of priority processing, the approval timeline for rural EB-5 petitions has been notably expedited. Currently, there is generally no waiting list for the rural TEA category, and investors require only I-526E approval to advance their Green Card application. Following the RIA, some rural TEA investors have achieved petition approval in under a year—an unprecedented pace in the EB-5 process.
